MEDIA · OCTOBER 2026

2007 FEDERAL ACCOMMODATION. NINETEEN YEARS WITHOUT PORTABLE RECOGNITION.

FTA ordered actual accommodation for disability-related inline-skate use in specified BART environments in 2007 while reserving the threshold classification questions. BART’s 2008 SamTrans pathway, California DMV’s 2022 individualized review and decades of documented accommodation followed. An October 2026 Swarovski access dispute illustrates the continuing frontline question, with incident details attributed to Troy.

On October 15, 2026, Troy Wilkes says an access dispute at the Swarovski store in Hillsdale Shopping Center led to police involvement and a trespass-related notice. The police report, notice and body-camera records are not publicly available in this package. Those incident details remain Troy’s account, not independently verified findings.

The earlier record is inspectable: Hillsdale approved conditional use in shopping-center common areas in 2001, and management acknowledged that arrangement in September 2026. The letter expressly says it does not automatically authorize use inside individual stores. Federal transit and DMV records document other, setting-specific reviews of the same disability-related use.

For the 2001 signed letter, an accessible transcription is available alongside the redacted facsimile. The HTML media sheet is an alternative to the one-page PDF.

WHAT HAPPENED AT SWAROVSKI?

Troy reports that the October 15 store-access dispute concerned his inline skates, which he uses as a disability-related mobility aid. He reports police involvement and a Swarovski-only trespass-related notice. Police involvement and the notice are presently reported by Troy; the requested primary police report, notice and body-camera records are not yet publicly available. The notice’s wording, scope, service and duration have not been verified here, and no reviewed Swarovski response is available.

Hillsdale’s 2001 letter concerned shopping-center accommodation and expressly distinguished decisions by individual stores. The September 2026 management message acknowledges that letter and gives management’s later position; it does not establish what happened inside Swarovski.

WHY THE NINETEEN-YEAR RECORD MATTERS

The 2006 complaint and today’s dispute involve the same person and disability-related use of inline skates. Institutions have examined that use in different settings, but their decisions have different scopes and do not create portable recognition. FTA required accommodation in BART station concourses and BART-controlled outside areas, subject to fact-based conditions, while accepting restrictions on platforms and rail vehicles based on the risks it analyzed. FTA did not finally resolve mobility-aid classification, and its BART determination does not itself decide Swarovski’s obligations. The DMV order records operation of a motorcycle and Class C vehicle using inline skates; it does not establish access rights in other settings.

Question for institutions: How can an individual obtain an actual federal accommodation directive in 2007, maintain documented accommodations for decades, and still encounter disputes over the same disability-related mobility function? The v49 proposal requests a joint written DOJ/DOT-FTA response on the directive’s continuing significance and reserved questions, current transportation and federal-building review within the relevant authorities, and portable recognition with bounded reassessment. A voluntary six-month pilot requires assessment of authority and funding.

THE EVIDENCE NOW INCLUDES MEASUREMENT

The governed program includes 55 same-day mobility experiments comparing Mall skating, pain-limited Walking and PT skating. It is N-of-1 evidence about Troy’s recorded conditions, not a general-population clinical conclusion. Sensors describe measured movement and exposure; they do not measure pain. These findings do not themselves establish a legal violation.
